Super Visa

Otherwise known as the Parent Visa in Canada or the Parent and Grandparent Super Visa, this visa belongs to the Temporary Resident Visas. It allows these close relatives to visit their children and grandchildren for a set period of time. The children or grandchildren must be Canadian Permanent Residents or Canadian Citizens.

Whereas the Visitor Visa could be used for this purpose, the Super Visa was created to lengthen the time that parents and grandparents could stay with their loved ones. The Canada Super Visa allows them to stay for up to 2 years at a time in Canada with their children and grandchildren if they fulfill the requirements.

During the time that parents and grandparents are in Canada with the Super Visa, they are not allowed to work or enroll in any part-time or full-time studies. They are also not allowed to try and get Canadian documents or Canadian benefits such as health care coverage. They are only allowed to stay with their relatives and visit the country.

Student Visas

The benefit of studying in Canada is that you get the right to bring your family as well as a spouse with you. You can also apply for an open work permit in Canada after the completion of your Studies. It is the ideal destination for International Students as the Canadian government provides complete rights and freedom of work while studying. MZ Legal and immigration Services has special courses for those students who wish to study and continue living in Canada Permanently. Work Permits (temporary foreign worker)

By working in Canada, you can gain Canadian work experience, which can help you to become eligible for settling here permanently. You require experience working in Canada if you wish to apply for the Provincial Nominee or Canadian Express Class. If you are not eligible for the federal skilled worker program, then working in Canada can be your ticket to the Canadian Permanent Residence. If you are applying under any of the Canadian Work Permits.

The requirements to become a temporary foreign worker in Canada are quite extensive. The Canadian Government wants to protect the jobs of their citizens and permanent residents therefore it requires proof that the foreign worker is absolutely necessary to a Canadian company. Because of this, the most essential requirement to become a temporary foreign worker is to have a Labor Market Impact Assessment (LMIA).

The LMIA is a document that the Canadian employer must get from the government. It certifies that the employer has tried to find an employee in Canada who is a citizen or permanent resident, but there was no one who was willing, available, or qualified to work that job. Because no person within Canada was found for that job, the employer needs a foreign worker. The LMIA takes a few months to get, therefore, the procedure must start as early as possible.

PERMITS

Post Graduate Work Permit

After graduation, many students want to get some work experience and Canada and ask whether they can find a job and stay for some time. The Canadian Government allows this if the student who just graduated is eligible and approved for a Post Graduate Work Permit (PGWP) in Canada.

The PGWP allows the graduate student to stay in Canada and work for a Canadian company depending on the duration of their studies and their eligibility.

The PGWP will essentially give you temporary residence in Canada and therefore has many requirements. To be eligible for the PGWP, you must fulfill the following requirements:

  • You must be at least 18 years old;
  • You must have studied in Canada as a full-time student for at least eight months;
  • You must have proof that you have completed your study program;
  • You must have graduated from one of the following institutions:
  • Public college or university in any Canadian province or a vocational education program from Quebec;
  • Private college or university which abides by the same rules as a public university or college in Quebec;
  • Private secondary or post-secondary school in Quebec which offers programs of 900 hours or longer and leads to a professional diploma;
  • Canadian private schools can award degrees such as a Bachelor, Master, or Ph.D.;
  • You must apply for a work permit within 90 days of your graduation;
  • You must have a valid study permit at the time of your application for the work permit.

Open Work Permit

An Open Work Permit otherwise known as an International Mobility Program for Canada is a type of work permit that is not specific to a certain job. All other work permits are issued for the holder to work for one employer, but the Open Work Permit allows you to change employers as long as the permit is valid.

Different from other types of work permits, the Open Work Permit does not require you to submit the following information:

  • A Labor Market Impact Assessment (LMIA) document that your employer would need to have;
  • Any proof that your employer has extended an offer to you through the Employer Portal or paid the employer compliance fee;

There are different conditions under which you can get an Open Work Permit. It may be completely unrestricted or have some restrictions as the Canadian Consulate sees fit. In general, there are three types of Open Work Permits:

  • Unrestricted work permits which allow you to change employers, occupation, and the location of work;
  • Restricted work permits which allow you to change employer but do not allow you to change your occupation;
  • Restricted work permits which allow you to change employer but do not allow you to change the location of work;

**The decision on what type of open work permit to issue you is up to the officer at the Canadian Consulate based on the documents that you submit when you apply.

To be eligible for an open work permit, you must fulfill several sets of criteria. One of the sets of requirements is your situation as to whether you can apply for the permit or not. You can only apply for an Open Work Permit if you are in one of the following groups:

  • A temporary resident permit holder.
  • An international student who has graduated from a Canadian educational institution and is eligible for a Post-Graduation Work Permit.
  • A student who cannot afford the cost of their studies.
  • A person who has applied for permanent residence in Canada.
  • A family member of a person who has applied for permanent residence in Canada.
  • A spouse or common-law partner of an international student or skilled worker.
  • A refugee, protected person, refugee claimant, or family member.
  • A young worker in special programs.

BUSINESS IMMIGRATION

Federal Skilled Trades Program

The applicants who are qualified in a skilled trade get an opportunity to quickly become Permanent Residents of Canada by applying their application under the Canadian Federal Skilled Trades Program. This program was developed by the Canadian Government and Immigration Department in 2013 to indicate that there is a shortage of skilled workers in areas where rapid growth is experienced due to the increase in economic strength. This program now runs through the Canadian Express Entry immigration selection system. To apply under this program applicant needs to have one year of full-time experience in a particular trade in the last five years to the time when the application was lodged. Applicants who have experience in part-time work that adds up to two years of full-time work also qualify for this program. Basically, experienced a total of 3,120 hours over the period of two years. They also need to show proof of the offer letter that they have received for a full-time job. Along with this, their English language proficiency is also checked for eligibility.

Start-Up Visa Investor Program

When looking to immigrate to Canada as an investor, the best option available is to apply for the general Start-up Visa Program. You will have to meet specific requirements for your application to be successful by being innovative, creating jobs for Canadians, and being able to compete internationally.

To qualify for the Start-up Visa, applicants must:

  • Have a qualifying business
  • Demonstrate intermediate knowledge in both English and French (CBL5)
  • Get a letter of support from a designated institution (Receive a minimum funding commitment of $200,000 CDN from a designated Venture Capital Organization, $75,000 from an approved Angel Investor, or Business Incubator)
  • Bring enough money to settle in Canada

Entrepreneur Program

Because they create employment opportunities and contribute to the Canadian economy, entrepreneurs are encouraged to apply for this immigration stream. Successful applicants are able to open a business in Canada, as well as gain permanent residence status in the country.

To qualify for the Entrepreneur Program, applicants must:

Establish, purchase or make a substantial investment in a business in Canada within two years of landing in Canada, which will result in a significant contribution to the economy

  • Engage in active and ongoing participation in the management of the business
  • Employ at least one Canadian citizen or permanent resident other than the entrepreneur and his dependents.
  • To ensure that these conditions are met, entrepreneurs are required to report to immigration officials their progress on a regular basis within these two years.

Self-Employed Persons Program

This business immigration stream is for those who will either establish or purchase a business in Canada that will make a “significant” contribution to the economy or the cultural or artistic life of Canada

  • Eligibility under the Self-employed person program:
  • have relevant experience (at least two years experience in the last five years)
  • be willing and able to be self-employed in Canada
  • meet the program’s selection criteria (minimum 35 points) and
  • meet medical, security, and other conditions
  • Selection criteria are based on experience, education, age, language abilities, and adaptability

Business PNP Programs

There are several business investment avenues through PNP programs across Canada:

British Columbia PNP / Manitoba PNP / New Brunswick PNP / Northwest Territories PNP / Nova Scotia PNP /Ontario PNP/ Prince Edward Island PNP / Quebec PNP / Saskatchewan PNP

*All of the successful PNP program applicants will get a work permit and will need to invest the monetary amount above within 1-2 years. Once job creation is completed, then the applicant can apply for PR

Live-in Caregiver Program (LCP)

Live-in caregivers who are specially qualified to provide care for children, Disabled or elderly in private homes without any caretakers. On getting the visa, caretakers are allowed to stay in private homes in Canada. The processing of this visa takes time as it requires proper work experience, a good hold of English or French language and a high school diploma. Under this program, you will have to provide care for at least 30 hours a week to children (under 18 years of age), the elderly (65 or over) or disabled Persons.
